1. Promoter

The New Subscriber Win Back Your Purchase Promotion ("Promotion") is conducted by Birkenstock Australia Pty Ltd (ABN 63 089 868 404) of Level 1, 551 Swanston Street, Carlton VIC 3053 ("Birkenstock Australia").

2. Promotion

(a) Customers who purchase at least one (1) pair of Birkenstocks online at www.birkenstock.com.au within 30 days of opting in to receive marketing communications from Birkenstock Australia will automatically be entered into the giveaway.

(b) One (1) winner will be drawn on the 30^th of each month. Any entries received on the 31^st, where applicable, will fall into the following month's draw.

(c) The winner will receive a refund to the value of the purchase price paid for one (1) eligible pair of Birkenstocks ("Prize"), up to a maximum of $500.

(d) Winners will be contacted via the email address provided at the time of entry.

3. Promotion Period

(a) The Promotion commences on 12:01 AM AEST on 1 September 2026 and continues monthly thereafter unless otherwise stated by the Promoter.

(b) The prize draw will be conducted monthly throughout the Promotion Period.

(c) Winners will be contacted within seven (7) days.

(d) Your entry will be included in the draw corresponding to the period in which your eligible purchase was made. Entries are only valid for the draw period in which they were received.

4. Eligibility

Entry is open to individuals who:

• ● Purchase one (1) pair of BIRKENSTOCK footwear online at  www.birkenstock.com.au during the relevant Promotion Period;
• ● Provide a valid email address at the time of purchase; and
• ● Consent to receive marketing communications from Birkenstock Australia and remain subscribed at the time of the prize draw.

5. Participating Stores

(a) This Promotion is available exclusively online at www.birkenstock.com.au .

6. How to Enter

(a) Eligible customers will automatically receive one (1) entry when opting in to receive marketing communications and completing an eligible purchase within 30 days. If opting in occurs at the same time the purchase is completed, the entry will also be included.

(b) A customer is only eligible for the draw once, based on the first date they agree to receive marketing emails from Birkenstock Australia and make an eligible purchase within the specified timeframe.

(c) Incomplete, fraudulent, or otherwise invalid entries may be deemed ineligible at the Promoter's discretion.

7. Prizes

(a) One (1) prize will be awarded each month during the Promotion Period.

(b) The prize consists of one (1) refund equal to the purchase price paid for the eligible pair of Birkenstocks, up to a maximum value of $500, to be distributed 30 days after the eligible purchase.

(c) Prizes are not transferable, exchangeable, or redeemable for cash.

8. Winner Selection

(a) The winner will be selected by random draw from all eligible entries received during the applicable draw period. Each entry will be assigned a random number, and a random number generator within Microsoft Excel will be used to select the winner. Customer information will not be shared with any third-party entities in the winner selection process.

(b) Winners will be notified by email within five (5) business days of the draw and must claim their prize within three (3) days of notification.

(c) If a prize is unclaimed, the Promoter reserves the right to conduct a redraw.

9. Privacy

(a) By entering the Promotion, entrants consent to receiving marketing communications from Birkenstock Australia.

(b) Entrants may unsubscribe from marketing communications at any time by using the unsubscribe link included in communications or by contacting Birkenstock Australia directly.

(c) Personal information collected in connection with this Promotion will be handled in accordance with Birkenstock Australia's Privacy Policy.

10. General

(a) The Promoter reserves the right to verify the validity of entries and entrants and to disqualify any entrant who tampers with the entry process or breaches these Terms and Conditions.

(b) The Promoter reserves the right to modify, suspend, or cancel the Promotion where reasonably necessary due to circumstances beyond its control.

(c) To the extent permitted by law, the Promoter is not responsible for any loss, damage, or injury suffered in connection with the Promotion or acceptance of a prize.

(d) These Terms and Conditions are governed by the laws of Victoria, Australia.

• (a) Customers who purchase at least one (1) pair of full-priced Boston clogs from a participating store or online at www.birkenstock.com.au during the Promotion Period and opt in to receive marketing communications from Birkenstock Australia will automatically receive one (1) entry into the Promotion.
• (b) Three (3) winners will be drawn each week during the Promotion Period.
• (c) Each winner will receive a refund to the value of the purchase price paid for one (1) eligible pair of Boston clogs (“Prize”) up to a maximum of $500.
• (d) Winners will be contacted via the email address provided at the time of entry.

3. Promotion Period

• (a) The Promotion commences on 12:01AM AEST 31 July 2026 and closes at 11:59PM AEST on 30 August 2026 ("Promotion Period").
• (b) The prize draw will be conducted weekly throughout the Promotion Period.
• (c) Draws will be run on the following dates and winners contacted within 7 days. The promotion includes four prize draws based on the date of your purchase:
• Draw 1: 7 August 2026 (for orders placed 31 July – 6 August 2026)
• Draw 2: 14 August 2026 (for orders placed 7 August – 13 August 2026)
• Draw 3: 21 August 2026 (for orders placed 14 August – 20 August 2026)

5. Eligibility

(a) Customers are entitled to receive one (1) complimentary Birkenstock Shoe Bag and one (1) Collectible Pin per eligible transaction. An eligible transaction is one that includes a single transaction with a full-price Boston clog.

 (b) One(1) Complimentary Anniversary Gift Set per eligible transaction

The Complimentary Anniversary Gift Set contains one (1) Birkenstock Shoe Bag and one (1) Collectible Pin will be provided per eligible transaction.

 (c) The complimentary Birkenstock Shoe Bag and Collectible Pin cannot be substituted or exchanged for any other Birkenstock items or products; they are not transferable, refundable, redeemable for cash, or redeemable for credit.

7. General

(a) Subject to any rights consumers may have under the Australian Consumer Law, Birkenstock Australia is not responsible for replacing complimentary shoe bags or pins that are lost, stolen, or damaged after collection.

 (b) If a purchase is returned, the gift must also be returned in new condition. Customers are responsible for return shipping costs unless the product is faulty or damaged, in accordance with the Promoter’s Returns Policy.

 (c) Birkenstock Australia reserves the right to amend these Terms and Conditions where reasonably necessary to administer the Promotion or comply with applicable laws. Any material changes will be communicated at the participating store.

Returns and Faulty Goods

Birkenstock Australia Pty Ltd is dedicated to providing their customers with quality products, ensuring that each transaction results in a satisfactory shopping experience. All full price products can be returned for refund if the product is unsuitable or faulty, provided they fit our returns criteria and/or pass the faulty assessment. Products must be returned in their original condition and packaging, that means that they must be in a new, unused, and unworn condition.

Reduced and sale items cannot be returned. Skincare and Shoe Care products are not returnable. Returns for these items and others that do not meet our return criteria will be rejected and sent RTS.

Upon receipt of your returned products, Birkenstock Australia Pty Ltd will happily reimburse you for the cost of the goods providing they meet our standard conditions for return.

We reserve the right to refuse a refund or charge a restocking fee if:

• • The products are marked, damaged or show signs of wear, this includes footprints and toe marks
• • The products are not returned in their original condition
• • The products are not returned with the original box or packaging
• • Due to the intimate nature of and for OHS reasons socks cannot be returned if the packaging has been removed.
• • Skincare and Shoe Care items cannot be returned.
• • Products purchased on sale or discounted items cannot be returned even if the size is incorrect. They are final sale items.

We will contact you if the items you have returned do not comply with our returns policy and are not eligible for a refund.

Damaged or Faulty Goods

If your order is damaged or faulty upon delivery, www.birkenstock.com.au will replace or repair them on the condition that written notification of their damage is advised (via email) to our customer service team within three (3) days of receipt of goods. The customer service team will advise how to proceed with returning the faulty or damaged goods as quickly as possible.

Goods damaged in transit must be returned to the offices of www.birkenstock.com.au within 14 days of receipt and notification of intent to return to be eligible for a refund. Birkenstock Australia Pty Ltd will cover any postage charges you incur if the product/s are found to be damaged in transit or found to be faulty.

All faulty claims are assessed on a case-by-case basis on site by our workshop. The customer service team must be notified of any defects or faults as soon as they present. Once a return authorisation has been issued, the item/s must be returned within 7 days. Faulty items will be assessed for reparability first in accordance with our commitment towards reduction and sustainability, as is our right under the ACCC guidelines to repair any goods where possible before replacement or refund after being subject to assessment.

Order and Delivery

Delivery Guarantee

At www.birkenstock.com.au we make every effort to have the items you want in stock at all times. In most instances, if a product appears on our site, we have it in stock. If an item were temporarily out of stock, a consultant would email you with an anticipated delivery date. If we are unable to source the item we will refund your order and may advise of an independent retailer that has been supplied the same item from Birkenstock Australia wholesale.

Birkenstock.com.au provides you with an estimated arrival period for each delivery as indicated by the freight provider, this period is the normal time taken to deliver goods to your area and may be subject to freight delays due to unforeseen circumstances.

If your delivery has not arrived within the estimated or expected time frame, customer service for www.birkenstock.com.au must be notified within 7 days in order to follow up and rectify the issue. Birkenstock Australia Pty Ltd are not responsible for items lost if we have not been contacted within 30 days of the order being despatched.

Order Status

For status updates, you can check your account information on the website or contact customer service with your order details. Check your junk folder if you have not received any order confirmation emails.

Cancellations

You may cancel your order at any time prior to the order being processed and despatched and incur no charge whatsoever. To enquire as to whether your order has been processed yet, please email us at help@birkenstock.com.au or if urgent, contact customer service on 1800 623 423 (option 1 for online).

If the order has already been sent for despatch we will be unable to cancel the order. Weekends and Public holidays are not operational. Your request will be responded to on the next working day.

Gift Cards

Gift cards are issued by Birkenstock Australia and are valid for three (3) years from the date of purchase, unless otherwise required by law. Gift cards are not refundable and cannot be redeemed for cash, except where required by law.

Gift cards purchased via birkenstock.com.au are redeemable online only at birkenstock.com.au by entering the gift card code at checkout. They cannot be redeemed in Birkenstock physical retail stores or with other Australian retailers or authorised stockists.

Gift cards may only be used towards the purchase of goods sold on birkenstock.com.au and cannot be used for service-based transactions, including but not limited to repairs or assessment services.

Gift cards may be used in full or in part. Any remaining balance will stay linked to the gift card for future use until the expiry date.

Multiple gift cards may be used in a single transaction. Gift cards may also be used in conjunction with other accepted payment methods, where applicable.

If a purchase made using a gift card is cancelled or items are returned, the portion of the purchase paid using the gift card will be reissued as a gift card balance. It will not be refunded as cash or to another payment method.

Gift cards should be treated like cash. Birkenstock Australia is not responsible for lost, stolen, damaged, or unauthorised use of gift cards.

Birkenstock Australia reserves the right to correct the balance of a gift card if a system or processing error has occurred and to cancel or refuse transactions where fraud, misuse, or breach of these terms is suspected.

Birkenstock Online and Birkenstock retail stores are independently operated entities, and gift card acceptance policies may differ between them. If you require a gift card for use in a specific physical store, please contact that store directly.

Nothing in these terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law.

These terms are governed by the laws of Australia.

Store Credit

Store credit is issued by Birkenstock Australia and can be redeemed online at birkenstock.com.au only.

Store credit is linked to your customer account. You can view your balance by logging into your account. Your available store credit will appear as a payment option at checkout when you are logged in.

Store credit cannot be transferred, resold, or redeemed for cash, except where required by law.

Standard store credit has an expiry of three (3) years. Where an expiry date applies to promotion credits, the expiry may differ, it will be clearly communicated at the time of issue.

Store credit may be used in full or part. Any unused balance will remain on your account for future purchases.

Where a purchase is made using store credit and the order is cancelled or items are returned, the portion paid using store credit will be reissued to your store credit balance. It will not be refunded as cash or to another payment method.

If a transaction involves both store credit and another payment method, refunds will be allocated back to store credit first, up to the original amount applied.

Store credit balances cannot be consolidated across accounts.

You are responsible for maintaining the security of your account. Birkenstock Australia is not liable for loss of store credit resulting from unauthorised use of your account where no fault of Birkenstock Australia has occurred.

Birkenstock Australia reserves the right to correct store credit balances if issued or applied in error and to cancel or refuse transactions where fraud, misuse, or breach of these terms is suspected.

Promotional store credit may be subject to additional terms and conditions, including expiry dates and usage restrictions, which will be specified at the time of issue.

Nothing in these terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law.

These terms are governed by the laws of Australia.

International Orders

We do not ship internationally and reserve the right to cancel and refund orders that have been placed from outside Australia through on-shipping services.

Dates and times are subject to change at the Promoter’s discretion.

3. Eligibility

1. Eligibility

1.1 Entry is open to Australian residents aged 18 and over.
1.2 Employees or immediate family members of management and staff at Birkenstock Australia are not eligible to enter.

2. How to Enter

2.1 Entries must be submitted via the online form no later than 5pm AEST on 30 July 2025.
2.2 Each participant may submit only one entry, consisting of a single file. This file may contain multiple designs, but only one file is permitted per person.
2.3 All entries must comply with the design requirements outlined in Section 3.

3. Design Requirements

3.1 The design must reflect the theme: Aussie Summer.
3.2 Artwork specifications:

• Format: JPEG, PNG or PDF
• Artwork size: minimum of 2480x3508 pixels
• Resolution: minimum 300 DPI
• File size: maximum 100 MB

3.3 Designs must be suitable for printing on canvas or fabric tote bags.
3.4 Designs must be original and must not infringe on any third-party rights. Do not include logos, imagery, characters, or symbols from other brands, companies, or copyright holders. Designs must also not contain any offensive, discriminatory, explicit, violent or illegal imagery. Any AI-generated content must be clearly disclosed.
3.5 Entries that breach any part of clause 3.4 will be disqualified.

4. Judging

4.1 Entries will be reviewed and judged by the Birkenstock Australia team.
4.2 Designs will be judged on originality, visual impact, relevance to the theme and suitability for print.
4.3 The decision of the judging panel is final.

5. Prizes

5.1 The winning entrant will receive $2,500 AUD in cash and 20 printed totes featuring their design.
5.2 Prizes are not transferable or exchangeable.
5.3 Any tax implications from the prize are the responsibility of the winner.

6. Intellectual Property

6.1 Entrants retain ownership of their design.
6.2 The winning entrant grants Birkenstock Australia a royalty-free, exclusive, worldwide license to:

• Modify the design as required for production

7. Notification and Announcement
